Railbike Adventures Limited is a limited liability New Zealand owned and operated company providing an outdoor leisure activity to the public. The safety of our customers while participating is our utmost duty of care and our safety procedures are stringently monitored by industry regulators to ensure that a high standard is maintained. The company is responsible for making arrangements to facilitate its customers for the excursions advertised on its website.
However, Railbike Adventures shall not be liable for any illness, accident or injury, damage or loss, delay or cancellation which may occur either directly or indirectly by way of weather, vehicle or infrastructure fault, or failure of company or persons engaged in conveying the activity to carry out duties due to adverse circumstance.
Reservations and Payments
Reservations can be made by phone, email or online via the website booking facility. Payments are to be made online using the merchant payment site. Payment in full is required at the time of booking.
Pay either by direct credit or debit card. All major credit cards are accepted but may incur a bank surcharge. Please phone the website contact number if neither of these payment methods are suitable. All payments must be cleared into the Railbike Adventures bank account before the booking is confirmed,
If you make payment via a debit to your nominated credit card, the amount debited at the time of booking confirmation will be in New Zealand dollars (inclusive of New Zealand Goods and Services Tax) on the booking page prior to you clicking "make payment" on that page. The deposit may be converted to your local currency by your credit card company. Depending upon the currency of the booking, your credit card's currency and the country in which your card was issued, your credit card provider may impose foreign exchange fees and other fees in accordance with your arrangements with that credit card provider. We are not responsible for currency conversion or any fees imposed by your credit card provider and any questions relating to such matters should be directed to them.
Should any foreign bank account bank fees be incurred by Railbike Adventures in refunding any payment; such fees will be passed directly on to the relevant customer(s).
Cancellation and Refunds
All cancellations must be submitted by email to gisborne@railbikes.nz.
Cancellation fees are charged per person at the following rates:
- Up to 48 hours prior to departure: 100%
- Up to 10 days prior to departure: 25%
- More than 10 days prior to departure: Free
We strongly recommend that if you have a large booking travel insurance should be considered.
Cancellations due to Rail Provider (Railbike Adventures)
Railbike Adventures reserves the right to alter amend or cancel any excursion should weather or any other circumstance under its control may a cancellation necessary. Once an excursion has departed no portion of the purchase will be refunded in the event that the excursion is forcibly cut short for whatever reason.
If any excursion is cancelled by The Gisborne Railbike Adventure due to weather before the ride departs all riders will get an email notification on the morning of the ride and will eligible for a full refund.
Medical Declaration
Participants are required to disclose all medical conditions, disabilities and phobias that may be experienced while undertaking the activity. A check box must be ticked on the participant liability waiver page prior to booking on the website.
Participant Responsibility
Participants must obey all Railbike Adventures staff instructions to ensure safe and cooperative conduct at all times. If a participant causes damage to Railbike Adventures property or vehicles or that of any third party their trip will be terminated, and the company will be under no further liability for refunds or costs incurred resulting from that damage.
By participating in this activity, you are expressly assuming all the risks and responsibilities of participation and are, to the maximum extent permitted by law releasing the Operator, its officers, employees, directors, agents and any other person associated with us, from any liability, claims, loss, damages or expenses (whatsoever and irrespective of whether direct, indirect or consequential) caused by any event including but not limited to: personal injury or death; property loss or damage; acts which may be construed as negligible or accidental; any other loss, damage, suffering, emotional or nervous disorder suffered by you or any other person in relation to this activity booked on or via this website. You accept that you have been advised to obtain adequate travel insurance for all persons named on the booking. You accept that all persons named on the booking are aware and agree to the terms of the participant and liability waiver you have checked prior to making your booking.
THE CONSUMPTION OF ALCOHOL AND SMOKING IS NOT PERMITTED AT ANY TIME WHILE YOU ARE PARTICIPATING IN THE ACTIVITY. Railbike Adventures reserves the right to refuse, terminate or allow further participation in the activity if the company suspects a participant in breach of this condition at its own discretion.
Information Security
When you place orders on Railbike Adventures, your transactions are encrypted using Secure Sockets Layer (SSL) encryption technology, the industry standard in e-commerce transaction security. Encryption scrambles the information transmitted across the Internet, including your credit card number, name and address. SSL also verifies the identity of the server and confirms that the original message arrives safely at its destination.
You can also be assured that your details are not stored on computers directly connected to the Internet and that personal information such as Credit Card numbers which you may choose to store, are stored in our back-end system and not anywhere on the Railbike Adventures web site.
Changes to Terms and Conditions
Railbike Adventures reserves the right to change these Terms and Conditions at any time without notifying customers. Any booking correspondence will be subject to the Terms and Conditions which apply at the time of booking.
New Zealand Governing Law
This website and the information contained within it and not pertaining to the terms and conditions alone are governed exclusively by New Zealand and participants agree to be governed by the exclusive jurisdiction of the courts of New Zealand with regard to company and its websites representation.
